How Trademark Registration Works
Most business owners assume trading under a name for years gives them some kind of claim to it. It doesn't. Anyone else can register that exact name tomorrow, legally, and you'd be the one forced to rebrand, not them.
We run a clearance search against the existing UK register before anything gets filed, whether you're looking to register a trademark for the first time or trademark your company name to protect it against a competitor. It's the step most businesses skip because it feels like an extra cost, when it's the thing protecting the £205 they're about to spend from disappearing on a mark that was never going to clear.
We've handled brand registration for businesses since 2008. The pattern is always the same, the businesses that come to us after a refusal wish they'd searched first. We'd rather you search first.

FAQs
How do I trademark a name in the UK?
Start by checking the UK trademark register for existing marks, identify the correct Nice Classification for your goods or services, and then submit an application to the Intellectual Property Office (IPO). This is the foundation of trademark registration in the UK, and the clearance search is an important step before submitting the application. Maspartner can help businesses understand the requirements and prepare for trademark registration.
Can I register a trademark online?
Yes. The UK Intellectual Property Office allows trademark applications to be submitted online. However, filing an application does not guarantee registration. Checking existing trademarks and choosing the right classes first can help reduce the risk of objections or opposition. These are important considerations when applying for trademark registration.
I've already registered my company name at Companies House. Doesn't that protect it?
No. Companies House registration and trademark protection are separate. Registering a company name does not give you exclusive rights to use that name as a brand, nor does Companies House carry out the same trademark checks as the IPO. If the name is important to your business, trademark registration in the UK should be considered separately.
Can someone else legally use my business name if I haven't trademarked it?
Potentially, yes. Without a registered trademark, you may have to rely on other legal protections, such as passing off, depending on the circumstances. A passing-off claim generally requires you to establish goodwill, misrepresentation, and resulting damage, so it is not the same protection as having a registered trademark. Trademark registration services can help businesses understand their options before a dispute arises.
Can I trademark a name that's similar to, but not identical to, an existing one?
Possibly, but similarity can create a conflict depending on factors such as the marks involved, the goods or services covered, and the likelihood of confusion. This is why checking existing registrations is an important part of trademark registration in the UK. A name does not have to be identical to an existing mark to face an objection or opposition.
Does my UK trademark protect me in the EU too?
No. A UK trademark protects your mark in the UK. Protection in the European Union requires a separate EU trademark application through the European Union Intellectual Property Office (EUIPO). If your business operates in both markets, you may need to consider brand registration in each relevant jurisdiction.
What happens if I don't renew my trademark after ten years?
A UK trademark registration normally lasts for 10 years and can be renewed for further 10-year periods. If it is not renewed, the registration can expire and the protection it provides can be lost. Keeping track of renewal dates is therefore an important part of maintaining your trademark registration.
